So, the big post about cpsia? Yeah, I posted that without “finishing” it, but now I can’t remember what else I wanted to add offhand :o

I sent the form letter from Handmade Toy Alliance to all three critters, although I have my doubts that it will do anything because it’s a reactionary legislation and if they change it or anyone gets seen voting “against” it, they’re gonna get railed …

Oh, I did get a form-response from one of the critters though:

Thank you for contacting me to express your concerns about the Consumer Product Safety Improvement Act of 2008. I appreciate hearing from you and welcome the opportunity to respond.

The Consumer Product Safety Commission (CPSC) is the chief agency responsible for protecting the public from consumer products that present unreasonable risks of serious injury or death. The failure of the Commission to properly inspect toys and other products entering our country has understandably frightened many parents and other consumers. These incidents, which have resulted in children and others being exposed to lead paint and other dangerous materials, are the consequence of the CPSC operating without sufficient resources or authority to inspect and regulate consumer products.

For these reasons I voted in favor of H.R. 4040, the Consumer Product Safety Improvement Act of 2008, which requires children’s products to undergo independent third-party testing and expands civil and criminal penalties for children’s products that contain lead. It also provides additional resources to the CPSC in order to expedite recalls and enhance its regulatory authority. This legislation was signed into law on August 14, 2008. However, as the rulemaking process to implement this new law goes forward at CPSC, I will be sure to keep your views in mind.

Again, thank you for letting me know your thoughts on this issue. Please do not hesitate to contact me further about this or any other matter.

I’m not quite sure he got the part where I am, basically, AGAINST it :o The message sounds like he might realize that I’m not cheering for the legislation, though, so maybe there’s hope. OTOH, if the problem is that the CPSC didn’t have the resources it needed, how does increasing the safety requirements and making people pay a third party resolve that? I mean, now it’s just offloading the responsibility. How about actually increasing the resources? :o

Last year, around this time actually I s’pose, was all the recalls and etc about toys made with high levels of lead. magic sand that turned into ghp when ingested. yadda yadda yadda. The CPSC (Consumer Product Safety Commission) was getting railed on because they weren’t catching most of these things, rather either the companies were or someone was getting ill or dieing and the resultant investigation was finding WOAH! This kids toy turns out is TOXIC!

Part of the problem was that the CPSC had like 1 or 2 people testing kids toys. Which meant they didn’t even vaguely get to everything. That started coming to light later, and is more of an excuse than a defense. But I can see their problem, if they don’t get the funding they don’t get the funding and they have to cut corners somewhere. So blame needs to pass up the chain to whoever can provide the funding.

Then apparently Congress decided to get into the act. Because, THE CHILDREN! OMG! The horrors! I can DO something about this! What should we do? Raise penalty fines? Increase CPSC funding? do like we did for the securities and mortgage companies, slap someone on the wrist, give them money to fix their problems, and make them promise to never never EVER do it again? Write new legislation that throws the biggest net we can find, requiring tests and independent certification? no, that would be ridiculous. who would pay for all that new testing?

Oh, we could make the companies pay for it! that way we don’t have to come up with any more money! EXCELLENT! If you know children, your products must be TESTED by INDEPENDENT LABS who will charge (reasonable? too harsh?) money! We don’t want to get into the business of regulating money, though, so we’ll let them decide what to charge. We’re sure they wouldn’t use a government mandate and complex (but not rigorous) certification procedures as an open license to commit robbery.

Bitter much? Yeah :o So the Consumer Product Safety Improvement Act (CPSIA) outlines various things that cannot be in products that kids can “reasonably put in their mouth.” Of course, if you have a toddler, you understand that kids can “reasonably” put the freakin’ refrigerator in their mouth, yaknow? But congress critters, they don’t have time to raise their own kids. The ones who bring them to DC with them put them in expensive private or even boarding schools, because lets face it. Mommy and Daddy are on capitol hill at all hours doing important work. The ones who’s families stay in Des Moines, well, obviously we’re not going to be seeing them every night.

The legislation is a big long document full of legislative branch legal jargon. So a lot of what I know is from the summaries I’ve seen elsewhere. Which, admittedly, are frequently on the handmade toy sites, etsy, and what kiir reads me from her cloth diaper and waldorf boards. But, generally, what I’ve gotten is the following:

  1. Companies must have their products tested, by third party independent certified labs, and documented as being lead, pthalate, and whatever else, free.
  2. The third party labs are charging on the order of 4000$US for such tests
  3. EACH toy or item must be tested. I imagine the toy kitchen can be sent as a single test and get the toy utensils it comes with. But if you sell the kitchen in green and red, that might be two tests. If you sell two kitchens (say one has an icebox, the other doesn’t), that IS two tests.
  4. You have to have certified resources used to manufacture, and you must be able to prove the trail. I’m not sure about this part, though, since it seems like it would be alternative to actual testing, assuming you could talk your suppliers into it of course. And why they’d care, I have no idea.

Thats what I’ve identified so far. What does this mean? Well, if you’re Hasbro, not much. Seriously, you sell 5000 bimbo beach cars this xmas season. That’s 1$ apiece on the price for the CPSIA lab test. Which you’ll just tack onto the MSRP as 2$ and BAM! you just made a profit off the testing!

But if you’re one of the etsy shops we like to buy handmade wood toys for DK from? Say, the shop we’ve bought two caterpillars, two car carriers, three cars, and a tow truck from? Those were ~30$ a pop I think. But, at best, that would be 16k in testing. Sure he sells a bunch of those items. But, hand carved by one guy? I think he sells maybe a dozen of each in a year? Lets say 2-dozen. That only raises the price from 30$ to 110$. oh, wait, at 110$ I wouldn’t have bought so much. So 150$. Well, now I might not have bought anything. Because DK doesn’t need 150$ toys!

Then things get funky weird. DK’s cloth diapers? Well, he CAN put them in his mouth .. BAM! 4000$ for testing! And I’m guessing that bamboo/velour/un-lined, snaps/velcro, died/undied would count as separate. And to be fair, we’ve gotten everything but velcro from his “normal” place at this point. That is, minimum 3 types. But combinatoric would probably be in play. Which means 3x2x2 … 12 options. 50k she’d spend on testing. ASSUMING that she could test each type once and be done with it. The diapers are, currently, 5-10$ apiece IIRC. We’ve bought 3-dozen, getting a fourth done smaller for baby girl now. I think she sells two slots a month, and old customers can always get in. So say she does 100 diapers a month. Thats 1200 in the year. Which, if the certification was annual, would add 40$ to each diaper (I think I did that math right). Sure, if it’s a permanent cert (assuming she doesn’t change dye or anything) (I would imagine that lots would need to be checked, since a new dye might have … but leaving that off) she could add a buck to each diaper and get her money back in … 40 years? 5 bucks and 8 years. Of course, in the meantime, she had to pop that 50k from somewhere and she doesn’t have huge pockets of cash like, say, Mattel. She might notice the extra 50k on her mortgage …

One thing that apparently got missed in the panic mode is that virtually all (all maybe?) of the issues came from the multinationals that outsourced their production to China for just pennies a day … The plants in the US weren’t producing these things. The European sources already have as strict, or stricter, requirements in place. The handmade craft places are, well, doing it by hand and probably not mixing the GHP and Arsenic with their Yellow #7.

Actually, at least one European company is pulling out of the US market because the extra fee for testing, they’re just not interested in it since they can already satisfy the stricter EU regs, they’re confident that they ALSO don’t have higher amounts to trigger these tests. But there’s no provision for that. No reciprocity.

Metro Madness at 11:02 pm

DC’s Metro differs from most (all) of the others I’ve been on in that the cost is dependent on the distance you ride. Possibly with some additional factors like whether your trip goes through the busy areas or something. But it costs a minimum of 1.65$ for a trip (such as the one station I ride between the train and the office to avoid walking through DC in the freezing cold). It goes up to 3-something.

Anyway, I tend to put 20$ on my metro pass at a time. When it gets down to ~5$, I’ll look for a chance to refill it. The other day going through a stile behind someone, I saw the display saying that their card had 200$+ on it. Wow. But OK, I use ~50 a month I think, and I’m doing minimum fares most of the time, so 100-200$ a month isn’t unreasonable I suppose. Seems like a lot, but 3$ each way, five times a week, four weeks is 120$, so if they have some extra for additional trips etc, maybe some leftover from last month’s allowance b/c of thanksgiving.

Then I saw someone last week who blew my mind. The card had ~2500$ on it. TWO AND A HALF THOUSAND DOLLARS! That’s like 80$ a day, counting weekends. If you add 5$ for parking (I don’t remember if it’s 3 or 5), I swear the max daily still caps at like 11$. Say 15 to be generous (even though weekends don’t have parking fees so it would average down not up). That’s still a bonus 60$ a day! Seriously, W T F!???

Pescatarian? Pescetarian?

Kiir points out occasionally when I saw that I’m vegetarian that I’m technically Pescetarian. Because I eat pesky people.

Of course, using a term like “Pescetarian” in public is just going to get you confusing looks. And since “vegetarian” has been so abused that it means everything from “I only eat vegetables” to “I eat everything except I don’t like corned beef”, it’s just as easy to say that I’m vegetarian. I try not to say that as I’m ordering fish, though, b/c I have enough problems and I don’t want to be part of the problem for the next guy who is really vegetarian and ends up with fish because “vegetarians eat fish.”

I usually just ask if there’s ANY meat in that? “Is there any kind of meat other than the crab in the crab dip?” “The Salmon and Asparagus just has salmon and asparagus?” Fairly straightforward. You’d think.

“The cedar plank salmon, that’s just the fish right?” “Yes sir.” … Comes out, and the salmon has bacon all over it … wtf? “The baked potatoes, are they vegetarian?” “Of course” “Then why are there bacon bits in them???”

Although I did love (same place actually as those two ; I only ate there the once with my in-laws … wonder why it’s not on MY list to go back to) asking about the french fries. What are the fries cooked in? “Oil?” Really, Sherlock? Damn. I was figuring maybe they were cooked in butterfly blood. What KIND of oil? And I could tell that his first reaction was that he WANTED to say “Hot?” But my mother-in-law jumped in and explained that I was vegetarian and wanted to know if the oil was vegetable oil. No, it’s peanut oil. Whatever, excellent. “But they sometimes toss the bacon drippings and some bacon into the oil” Even more excellent. PASS!

Come ON people! Vegetables give places this much trouble, no way in heck am I even TRYING something as complex as “pescetarian”!!!

So, DK has apparently decided that sleep is for losers.

To-wit, the last two nights it was midnight, or after, when he went down. Tonight he went down a bit early. This is only the second time in two weeks he’s gone down before 11 (10:45 IS before 11, even if we went up at 10 for bed)

Obviously this is leaving me disinclined towards doing much in the evening. I will get to posting eventually

Airport “Security” 6 November, 2008 at 1:46 pm

So, we went through a lot of security garbaggio recently in our trip to India. And there were a few “WTF?” moments involved.

First off, we got to National (DCA), checked in, checked the luggage, and then went to security. Went through. Kiir got through. Dad got through. I got through, with DK on my back. My mom got flagged for beeping in the metal detector.

Then she got wanded and security went through the two bags she had. Her purse and a yellow plastic bag from some store or other she’d grabbed for a few items. Like DK’s coat, i think, was in there. After all this, they let her through and it was determined that the rivets on her jean pockets went bing. Which is strange, since mine didn’t and my metal belt buckle went through without a hitch …

while we were waiting for boarding, my mom reaches into her yellow translucent plastic bag and pulls out DK’s sippy. half full of water. THEN it hits us all that “wait, wha? How did THAT get through security without a blink or a question???”


When we landed in India, my relatives weren’t inside to meet us. We landed an hour early, so you know, maybe they just hadn’t gotten there yet. But my dad went looking around, and went outside and found them waiting outside the aiport. Because apparently they weren’t allowed into the arrivals area to meet arriving passengers. On the outside of security, customs, immigration, etc, everything.


On the way home from India, at Indira Gandhi International Airport (IGI), my relatives were going to wait outside, but my parents were going to come in with us at least as far as check-in. Obviuosly they’d never get through security without tickets, but you know. An extra hour with us before we came home and they’re there another three weeks.

Except, apparently, you can’t get in to TICKETING without proof that you have a flight. Good damned thing we had the e-ticket confirmation papers :o So we said goodbye at the door (while my dad was arguing with the cops with semi-automatic rifles) and went in just the three of us. Checked our bags, and then got handed the customs emmigration papers for leaving India. Which included wanting the address and phone # where we stayed. Well, hell. That was on our luggage tags, which we just checked. My dad had all that information on the way in. Oh! I’ll go check.

Yep, they’re still standing outside with the rest of the family. Presumably waiting for the taxi to make it back to pick them up from wherever the taxi waiting lot is. (they hired it for the round trip). Great. I went and grabbed the boarding passes and passports for me and DK and went to the exit, figuring I’ll go get the info, then come back in. No exit at this exit. Use one of the others. OK. Go to the entrance we used and tried to exit. Nice cop with the semi-automatic rifle informed me, in bad english, that once you’re inside there’s no LEAVING the airport. Except on a plane, presumably. Or a body bag. But certainly not by walking out the front door again.

So, we dropped K off for the trip. Unlike the vacation to NC earlier this year, we couldn’t really leave him home. Drummer has a job and lives in NoVA now, bit of a drive … My folks are going with us, they certainly can’t check in on him. My friends in the area all work, so I couldn’t really ask them to look in on him. And I wouldn’t want to see the bills for calling every few days to check in :o So we went back to the kennel we used to love so much.

And there’s been some changes. All new people in the front, and we understand that the management has changed again since last fall when he got banned from daycamp. Apparently the “permanent ban” wasn’t quite as permanent, since there’s nothing in the computer about it.

We told them that he’s door agressive, so when someone goes out the door, he has to be tied up or he will attack whoever is leaving to try to make them stay. I don’t know that they wrote that down anywhere other than “door aggressive”, but we’ll find out. I also pointed out that if he’s attacked , he will defend himself. He’s not aggressive, but he’s not passive either. Guy checking us in seemed to think that was a given and DUH of course he defends himself. Apparently we’re not the only ones that thought that NOT defending himself was unusual :o

Honestly, I don’t expect him to get to stay in camp more than a week, but we’re hopeful that maybe they’ll listen. And there’s still a few people there who know K from before, so I figure even if he gets kicked from camp again, they’ll play with him some. Maybe not as much as he used to get, since there’s only a few of them left AFAICT.

So, we actually finished packing 90% like 4 days before we left … It was eerie!

We spent the next few days running around and getting this that and the other to fill out the carryons and the few things we needed still for the suitcase.

We have two big checked bags, one of which actually has a third inside of it in case we need it for the trip home. Then kiir has a backpack and a carryon suitcase, I’ve got a small bag, and des has a small backpack. Plus the big carseat thingie.

It’s going to be a BLAST hauling around an airport. Especially JFK when we get off the plane, go through to get our bags, turn around and check in at another flight, check the bags again, and come BACK through security. In like 3 hours. *sigh* If we didn’t have to check in, I’d say kiir and DK could stay inside security and then I go through and move the bags around. That way the carryons and toddler don’t have to go through security again :o

So, this evening after work, I was going to Chiro. But I figured the CostCo is on the way (relatively speaking) and it’s like 20c cheaper a gallon. And I need gas.

So first I get there, and it turns out it’s 40c cheaper (273 vs 315). Then there’s this huge freakin’ line, so I’m throwing it into neutral while we wait, because the needle is kinda straddling that zero marker … “need gas” light came on this morning on the way to the train, I need gas …

TWENTY MINUTES that line took. And then .. and then … *sigh* effing pump can’t read my debit card!!! ARGH! I no longer HAVE an alternative, I’m basically OUT OF GAS dammit! *sigh* drove across the parking lot, ran into the costco itself, got a cash card, came BACK to the station and … sit in another 10 minutes of line. OH. GOOD. GRIEF.

13ga tank. Took 14.8ga. I think, off the cuff here, but I *think* I may have been running out of gas :o

I guess I need to call the bank and get a new debit card issued. Because it didn’t work at joanns this evening either. And of course that’s gonna cost me 5$ for “replacement card” … not because I lost the effing thing, but because it just quit working!

So, it’s been pointed out (repeatedly, by MANY people) that the title of this blog is misleading. poorly worded. a bald faced LIE, even.

Because let’s face it. It’s not daily. Even if I manage to do daily/weekdays for a bit, it never lasts more than a week or two. And then there’s the problem that I’m frequently posting in the evenings and I’ll come up with two or three posts and either put them all up at once or I have to schedule them to trickle out, and I STILL don’t hit daily very much.

Also, I don’t really “gripe” as much as I used to. More “commentary” and “observation” with some kvetching.

So I’m thinking about changing it. Keeping the URL an’ all the other stuff, just changing the title and the tag.

Frankly, I’m kindof thinking of using the Psychotomy from the url. Basically like:
Pyschotomy
When a disordered mind breaks up

Because if a psychotic break is when a well ordered mind breaks down …

But I’m open to other suggestions. Since I don’t post many DK pics (I figure Kiir’s got that covered quite well ;) I’m not really sure that I have a focus at all …
